MyBlockStudio Terms of Service

Article 1 (Purpose)

These Terms define the rights, obligations, and responsibilities between the operator, Kim Taewon (hereinafter "Operator"), and the users of MyBlockStudio (hereinafter "Service").

Article 2 (Service Overview)

The Service is a web platform for creating, sharing, and selling block designs. The Service includes the following features:

  • Block design creation and saving (2D/3D)
  • Design publishing and sharing
  • Deform block purchases
  • NFT minting
  • Points system and creator revenue sharing

Article 3 (Eligibility)

1. The Service is available only to individuals aged 14 or older. Age confirmation is required during registration.

2. If a user under 14 is identified, the Operator may delete the account.

3. Product purchases and NFT transactions are limited to users aged 18 or older, or those with consent from a legal guardian.

Article 4 (Accounts and User Obligations)

1. Users must register with accurate information and promptly update any changes.

2. Users are responsible for maintaining the security of their account information and may not transfer or share it with third parties.

3. The Operator is not liable for damages caused by unauthorized use of accounts.

4. Users are fully responsible for all content they create and post.

Article 5 (Collection and Use of Personal Information)

1. The Operator collects the following personal information to provide the Service:

  • Email address (user identification and notifications)
  • Nickname (in-service display)
  • Password (stored encrypted)
  • Shipping address (for product purchases)
  • Wallet address (for NFT transactions)
  • Social login information (account identifiers from LINE, Google, Kakao, etc., when using social login)
  • Full name (for shipping when purchasing products)
  • Phone number (for delivery-related contact)
  • Bio (profile display within the Service, optional)

2. The following information may be automatically collected during use of the Service:

  • Access logs, IP addresses, browser information
  • Cookies (for login persistence and language settings)
  • Payment history and transaction records

3. Collected personal information is used solely for providing the Service, responding to inquiries, improving the Service, and processing transactions.

4. Personal information is destroyed without delay upon account deletion, except where retention is required by applicable laws.

Article 6 (Copyright and Content)

1. Copyright of designs created through the Service belongs to the respective user.

2. By posting designs on the Service, users grant the Operator a non-exclusive license to display, share, exhibit, and use the designs for sales promotion within the Service.

3. Users warrant that their content does not infringe upon any third party's copyright, trademark, portrait rights, or other rights.

4. All legal liability arising from infringing content shall be borne by the user who created and posted such content. The Operator assumes no responsibility.

Article 7 (Content Management and Access)

1. Users may set their content as public or private.

2. The Operator may access all content, including private content, in the following cases:

  • Inspection and handling of reported content
  • Investigation of Terms violations
  • Response to requests based on applicable laws
  • Service operation and resolution of technical issues

3. The Operator will not view users' private content or disclose it to third parties for purposes other than those listed above.

Article 8 (Prohibited Content)

Users may not create or post the following types of content:

  • Content infringing on others' copyright, trademark, or portrait rights
  • Unauthorized reproductions of characters from anime, manga, games, movies, etc.
  • Unauthorized use of celebrities' or public figures' likenesses
  • Unauthorized use of corporate logos or brand marks
  • Obscene or sexually inappropriate content
  • Violent or graphic content
  • Hate speech targeting specific individuals or groups
  • Content containing spam, advertisements, or malware
  • Any other content that violates applicable laws

Article 9 (Content Removal and Usage Restrictions)

1. The Operator may remove content that falls under Article 8 or is deemed inappropriate for service operation without prior notice.

2. The Operator may suspend service access or delete accounts of users who violate these Terms.

3. Users who object to usage restrictions may file an appeal with the Operator.

4. If a copyright infringement report is accepted, the Operator may immediately remove the content and suspend related sales and revenue distribution.

Article 10 (Product Purchases and Payment)

1. For details on product purchases, please refer to the "Specified Commercial Transactions Act Disclosure" page.

2. Payment is processed via credit card (Stripe), PayPay, and points. Cancellations and refunds after payment are subject to the return policy.

3. Points may be used for the entire order, including product price and shipping (1 point = 1 yen).

4. Points are granted and used as determined by the Operator and cannot be exchanged for cash.

5. Product shipping is available only within Japan. International shipping is not available.

Article 11 (NFT and Blockchain Transactions)

1. NFT minting is performed on the Polygon blockchain network.

2. Blockchain transactions are irreversible. The Operator cannot process refunds or cancellations after a transaction is completed.

3. Gas fees (network fees) are borne by the user.

4. The Operator is not responsible for blockchain network failures, delays, or security issues.

5. Wallet management is the user's responsibility. The Operator is not liable for losses due to loss of private keys.

6. The NFT registration provided by this Service is a technical service that records users' digital data on the blockchain. It does not constitute the buying, selling, brokering, custody, or investment advice of crypto assets or NFTs.

7. No guarantees are made regarding the value, future price fluctuations, resale potential, or profitability of NFTs.

8. Due to the nature of digital services, refunds are generally not available once NFT registration has commenced.

Article 12 (Points System and Creator Revenue Sharing)

1. When blocks are purchased using a user's design, points equivalent to 10% of the design's block count are awarded to the design creator (rounded to the nearest whole number).

2. Points are also awarded when purchasing using one's own design.

3. Points are automatically awarded upon order completion (delivery confirmed).

4. Point amounts are calculated uniformly based on the design's block count, regardless of payment method (cash or points).

5. Revenue from content confirmed to infringe on rights will be forfeited and cannot be reclaimed.

6. Points expire 2 years from the date of acquisition. Expired points are automatically forfeited.

Article 13 (Service Changes and Termination)

1. The Operator may change or terminate all or part of the Service.

2. In the event of service termination, the Operator will provide at least 30 days' notice and endeavor to provide a period for users to back up their content.

3. The Operator is not liable for damages resulting from service changes or termination.

Article 14 (Disclaimer)

1. The Operator is not liable for service interruptions caused by force majeure such as natural disasters or system failures.

2. The Operator is not responsible for copyright infringement, rights violations, or any disputes arising from content posted by users through the Service.

3. The Operator does not involve itself in disputes between users or between users and third parties, and assumes no liability therefor.

4. All legal claims and damage claims arising from user content shall be handled by the relevant user, and the user shall compensate the Operator for any damages incurred.

Article 15 (Changes to Terms)

1. The Operator may change these Terms as necessary.

2. Revised Terms will be announced through in-service notifications and will take effect 7 days after notification.

3. Users who do not agree to the revised Terms may discontinue use of the Service and delete their account.

Article 16 (Governing Law and Jurisdiction)

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising from the use of the Service shall be subject to the exclusive jurisdiction of the Saku Branch of the Nagano District Court as the court of first instance.
